Your next employment offer will come with a lengthy contract. The contract is usually at least seven pages long with as many details as you can imagine. Are you a fresh graduate? Have you seen the likes of this before? The hiring manager will pass it off as a mere formality. They’ll give you a few minutes to skim through the contract, but that’s about it. Here’s what you should do: ask for two days at least to read the contract. Do not ever sign it without reading what it entails.
Candidates tend to be too excited about receiving a job offer (and rightfully so) that they will sign the first contract they see. But this is what’s wrong with the whole process. You might be signing something you are not up for. Are you sure you want to work on holidays, for example?
Is It a Contract?
Determining whether you’re signing a simple job offer or an employment contract is essential. A job offer usually has information about how much you are getting and other benefits and compensations. It also typically has details about the job that you have to do. An employment contract will be more generic, but that doesn’t mean it is less important.
The contract will tell you about the termination process and other things related to your employment in the company. Without this detail, employers may terminate you for whatever reasons they can think of. This is why you must also bring the contract to a reputable lawyer, so you can ask as many questions as you need to know about what you might be facing in the future.
What Does Your State Law Say?
In New York, your employers don’t need to pay your accrued vacation time if you leave before 12 months of your employment. This isn’t the case in other states. Research your state laws and how they might affect the terms of your employment. Make sure to raise the issue with the hiring manager if some of the provisions in the contract do not conform to your state’s laws.
How Much Are You Going to Get?
It’s also important to know the details of your wages and compensations. How much is your base salary? How much are you going to get as net income? Consider the deductions before you get blown over by the amount of the salary. Is the company going to provide other benefits and compensations? After eight hours of work, how much will you get for each hour of overtime work?
Does It Offer Job Security?
Can your employees terminate the contract without cause? What is going to be considered as a justifiable cause for job termination? Contracts should specify the reasons why an employee will get fired. If there is an automatic termination clause, talk this over with the hiring manager. If there is a reason for you to get fired, you should receive some notice or give you time to correct the mistakes. Ideally, you need two months of notice before the employers terminate the contract. That gives you enough time to find other employment, too.
What Are Restrictive Clauses?
The restrictive clauses often give employees headaches when there’s a problem in the organization. These clauses are meant to protect employers. They mean that employees cannot take certain actions that will harm employers. Three of the most popular restrictive clauses are non-compete, non-solicitation, and confidentiality. Employees should make sure they can abide by these rules to prevent a possible lawsuit.
You have to sign an employment contract with confidence. The only way you can do that is if you understand the terms and conditions of the contract. Take time to review the contract with a legal expert, if possible.
